Why You Need A Conveyancer When Buying Land

Law Blog

Most people forego conveyancing services when purchasing land. It is especially so since they perceive land purchasing as a straightforward transaction since the property does not have any buildings. Nevertheless, a conveyancer comes in handy when buying land. Below are some compelling reasons to engage the professional.

Verifying The Property Registration Details

It is easy to assume that the property is legally registered once the current owner presents a title document with their name and identification details. However, this is not always the case. Minor errors in the title document could make the document invalid. Your conveyancer checks the local lands register to verify the authenticity of the title document. For instance, do the plot number and size correspond with those in the lands registry? Such due diligence helps prevent land disputes in the future.

Moreover, the professional examines whether the property has outstanding easements that could affect how you use the property. For example, a neighbour could have an easement that prevents you from building structures that face their property. On the other, the local power company could have secured an easement that allows them to install overhead power lines on the property. Such an easement prevents you from building property close to the lines.

Establishing The Qualities Of The Property

A conveyancer helps you establish the qualities of the property you intend to purchase. For instance, they conduct background research to determine the property's prevalence of disasters such as floods and fires. The conveyancer could also assess whether the land sits on a reclaimed landfill. The conveyancer's assessment helps you determine if the property is a worthy purchase. Moreover, it lays the foundation for your development goals. For instance, if the area experiences wildfires, you could opt to retrofit buildings at the site with fire-retardant materials. You could also build a stormwater drainage system to prevent flooding on the property.

Determining The Impact Of Local Land Regulations

Local councils have various land development regulations. Your conveyancer is your best bet at comprehending these regulations. For instance, they acquaint you with zoning regulations that determine how you can use the property. For example, some areas are zoned for agricultural use while others are reserved for commercial buildings. Flouting these regulations could cause legal issues in the future. If you intend to subdivide the property, your property lawyer ensures you do not disregard the subdivision regulations. For instance, the local council could require developers to install essential amenities. Besides, the council sets a minimum plot size.

Dealing With Divorce

Hello, my name is Sandra. I live with my two children in Eastern Australia. I have recently come through a very difficult divorce. My ex-partner used to drink too much and he wasn't a very good husband or father. The final straw was when I discovered he was having an affair. I filed for divorce the same day. I knew that getting divorced would be difficult but I didn't realise just how difficult. My husband did all he could to make it hard for me and the kids. Thankfully, I found a fantastic family lawyer who helped me through the entire process. I won custody of the kids and my husband has been asked to pay child support. I decided to start this blog to help others who are going through a divorce.
